3. Payment and Billing

All fees for game server hosting services are due in advance. Services are billed on a recurring basis according to your selected billing cycle and will continue until cancelled. You are responsible for ensuring your payment method is valid and has sufficient funds.

We reserve the right to change our prices at any time. Price changes will be communicated to existing customers before taking effect on their next billing cycle.

Creating multiple accounts or providing false information to circumvent promotional eligibility requirements is considered fraudulent activity. This includes but is not limited to creating new accounts to access promotions intended for new customers. Such activity will result in termination of all associated accounts without refund.

4. Chargebacks and Disputes

If you wish to request a refund, you must follow our Refund Policy by submitting a support ticket. Initiating a chargeback or payment dispute with your bank or payment provider without first following our refund process is a violation of these Terms of Service.

Chargebacks initiated without following our refund process may result in immediate termination of your account and services, and we reserve the right to pursue collection of any amounts owed.

5. Acceptable Use Policy

You agree to use our services only for lawful purposes and in accordance with these terms. The following activities are strictly prohibited:

• Hosting servers designed for cheating, hacking, or "hack versus hack" (HvH) purposes
• Launching or facilitating DDoS attacks or any form of network abuse
• Hosting illegal content including gambling operations, child exploitation material, or content inciting hate, violence, or discrimination
• Distributing spam, malware, viruses, or other malicious software
• Port scanning or probing networks without authorization
• Harassing, threatening, or defaming other users or individuals
• Infringing on intellectual property rights or distributing pirated content
• Any activity that violates applicable laws or regulations

We reserve the right to determine, at our sole discretion, whether any activity violates this policy. Violations may result in immediate suspension or termination of services without refund.

6. Resource Usage

Our services operate under a fair use policy. Your resource usage should be consistent with normal operation for your selected plan. Activities that consume excessive resources and negatively impact other customers or our infrastructure are prohibited.

Cryptocurrency mining is strictly prohibited on all servers. Excessive resource usage may result in throttling, suspension, or a requirement to upgrade your plan.

7. Technical Support and Modifications

Our technical support covers the vanilla game server software and official Minecraft modpack installations through our control panel. We can assist with server connectivity issues, control panel functionality, and general server management.

Third-party modifications, custom mods, plugins, and configurations are the sole responsibility of the customer. We do not provide support for troubleshooting, configuring, or maintaining third-party modifications. Installing mods or plugins may affect server stability and performance, and any issues arising from such modifications are not covered by our support.

We recommend testing modifications in a development environment before deploying to your live server, and maintaining backups before installing any third-party content.

8. User Content

You are solely responsible for all content hosted on your server, including game files, mods, plugins, and any user-generated content. We do not actively monitor server content but reserve the right to review and remove any content that violates these terms.

By using our services, you grant us a limited license to store, transmit, and display your content solely for the purpose of providing the hosting services.

9. Data and Backups

You are solely responsible for maintaining backups of your server data. While we may provide backup tools or services, we do not guarantee the availability, integrity, or recoverability of any data.

GhostCap Gaming is not liable for any data loss, corruption, or destruction, regardless of cause. We strongly recommend maintaining your own regular backups of all important data.

10. Service Termination

We may suspend or terminate your access to our services immediately, with or without notice, for any reason including but not limited to: violation of these Terms of Service, non-payment, fraudulent activity, or conduct that we determine to be harmful to our services, infrastructure, or other customers.

Upon termination for cause, you will not be entitled to any refund of prepaid fees. You are responsible for exporting your data before termination, as we may delete all data associated with your account after termination.

You may cancel your services at any time through the billing portal. Cancellation will take effect at the end of your current billing period.

11. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. GhostCap Gaming makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

In no event shall GhostCap Gaming, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services. Our total liability shall not exceed the amount you paid to us in the six months preceding the claim.
